On January 9, 2019, the Terms and Conditions governing the operation of the AURA TATTOO tattoo studio were established.
These Terms and Conditions define the rules for providing services offered by the Studio.
The Terms and Conditions apply to services performed during their period of validity.
The following provisions apply to services offered to clients by the individual conducting business under the name AURA TATTOO, Tax ID (NIP): 9671285193.
Service – the performance of a tattoo, i.e. the preparation and execution of a procedure consisting of placing a permanent design on the client’s skin by introducing pigment under the skin;
Studio – the AURA TATTOO business;
Session – each scheduled date of service performance;
Agreement – the legal relationship established between the Studio and the Client for the performance of the Service;
Tattoo Artist – a person performing the Service as part of the Studio’s business activity or a person renting a workstation and providing services in their own name and on their own account;
Client – an adult person commissioning the Service from the Studio or from a tattoo artist renting a workstation.
Services offered by the Studio are provided on the basis of an agreement concluded at the Studio’s premises. The subject of the Service is the performance of a tattoo.
Agreements are generally concluded orally. Upon the Client’s request, the agreement may be concluded in writing.
Booking a session date does not constitute the conclusion of an agreement unless the Client pays a deposit in the agreed amount.
The Client is obliged to present the essential assumptions of the Service, i.e.: the placement of the tattoo on the body, its size, and guidelines concerning the design (including color scheme or style). The design prepared for the Client must be approved by them. The Client may submit suggestions or objections to the design, which should be taken into account by the tattoo artist whenever possible.
The Client is required to provide written consent to the tattoo procedure and to complete a medical questionnaire concerning relevant health issues. Personal data will be processed in accordance with applicable personal data protection regulations.
The Service is provided for a fee. The remuneration is determined individually, depending on the size of the tattoo, the materials required, and the amount of work involved.
To secure proper performance of the agreement, the Client is required to pay a deposit. The provisions of Article 394 of the Polish Civil Code apply directly.
The remuneration must be paid no later than on the day of the Service, and the deposit paid shall be credited toward the total amount.
If the Client fails to appear at the agreed session date, the paid deposit shall be retained without the Client being entitled to its refund.
The tattoo design must be approved by the Client. The Client has the right to request an explanation of the entire tattooing process, and the tattoo artist should answer all questions related to the performance of the Service.
The tattoo artist informs the Client of all essential issues related to the tattoo procedure, including the healing process and skin care.
Before commencing the Service, the Client must complete and sign a medical questionnaire. Refusal to complete the questionnaire will result in withdrawal from the agreement and retention of the paid deposit. The tattoo artist may refuse to perform the tattoo if the Client appears at the session under the influence of alcohol or psychoactive substances. The tattoo artist may also refuse to perform the Service in the event of the Client disclosing infectious diseases – in such cases, the deposit shall be retained.
The Service is performed during a session. The session includes consultation, discussion of the design, and execution of the tattoo procedure consisting of introducing pigment under the Client’s skin. During the session, the tattoo artist ensures proper preparation of the workstation.
The Service is performed at the Studio (the business premises), at a workstation specifically prepared for this purpose, located in the so-called clean zone. The Studio ensures appropriate safety and hygiene conditions, in particular cleanliness and sterility of objects that come into direct contact with the Client’s skin. During the tattoo procedure, the Client is required to remain calm and follow the tattoo artist’s instructions. Failure to comply may result in the session being interrupted and refused continuation, which constitutes withdrawal from the agreement due to the Client’s fault, with the deposit being retained.
During the session, the highest level of cleanliness must be maintained. It is prohibited to use items not approved by the tattoo artist or to consume meals.
If the agreed session was insufficient to complete the Service in full due to reasons attributable to the Client – in particular excessive breaks, poor pain tolerance, or requesting numerous changes – the Studio may require additional remuneration for scheduling an additional session to complete the Service.
If the Client notices the need for corrections, they may schedule a correction session after consultation with the Studio, no later than within 2 months. Corrections resulting from improper aftercare by the Client shall be chargeable.
The Studio is divided into a publicly accessible area, where persons without a scheduled session may stay (e.g. to book an appointment or conclude an agreement), and the service area – the so-called clean zone – where only the Client and the tattoo artist may be present during the scheduled session.
The Client should not attend the session with accompanying persons. Exceptions are permitted only under individually specified conditions and require the Studio’s consent.
In the event of a break or the need to leave the workstation, the tattoo artist secures the tattoo. The Client should not leave the workstation without proper protection and without informing the tattoo artist.
The Client may document the performance of the Service at the Studio via social media.
The use of devices such as smartphones is permitted; however, the rule described in §5(4), second sentence, applies – activities related to taking photos or videos by the Client must not interfere with the tattoo artist’s work. The Client is obliged to follow the tattoo artist’s instructions.
The Studio reserves the right to record the course of the Service for promotional or marketing purposes. The use of the Client’s image is limited to the scope of the consent granted by the Client.
The Service is performed on a date agreed with the Client. The Client is entitled to change the agreed date once, provided the change is requested no later than 7 days in advance. A subsequent change is permitted; however, the deposit paid for the previously agreed dates is retained and an additional deposit is required.
If the performance of the Service requires several sessions, the tattoo artist informs the Client accordingly. The agreed remuneration should take into account the total workload in advance.
Any significant change to the essential assumptions of the Service requiring preparation of a new design, change of tattoo artist, or scheduling of a different session date is considered a new Service. In such a case, the paid deposit is retained and the Client is required to conclude a new agreement.
A session date may be booked via a contact form, social media communication, by phone, or in person.
A guaranteed session date applies only after payment of the deposit. Payment of the deposit constitutes conclusion of the agreement. If the deposit is paid by bank transfer, the written form of the agreement is provided to the Client on the day of the session. The Client may request that the agreement content be sent to a specified e-mail address.
The Studio is not responsible for the Client’s state of health. The consent to perform the Service and the medical questionnaire constitute declarations by the Client, who is obliged to answer the questions truthfully.
Contraindications to the Service include strong suntan, skin diseases, visible allergic reactions, pregnancy, and other conditions that may pose a risk to persons present in the Studio.
The Client is obliged to obtain information regarding any health contraindications from a physician prior to the session.
If any medical obstacles are revealed, the tattoo artist will refuse or interrupt the performance of the Service. The provisions regarding the deposit shall apply.
Due to the nature of the services provided, a Client familiar with the agreement provisions and these Terms and Conditions is not entitled to the statutory right of withdrawal from the agreement. Prior to the Service, the Client is informed of all essential issues and permanent effects.
In the event of defective performance of the Service, the Client is entitled to submit a complaint. Complaints should be submitted in documentary or written form to the Studio’s correspondence address.
A complaint should include sufficient identification of the Client, a detailed description of objections, and a specified claim. The Studio will initiate the complaint procedure without undue delay, no later than within 30 days of receiving the complaint or supplementation of deficiencies indicated in the response. Failure to supplement deficiencies upon the Studio’s request will result in the complaint being left unexamined.
The Studio reserves the right to amend these Terms and Conditions. Clients will be informed of any changes.
In the event of disputes arising from performed services that cannot be resolved amicably, the competent court shall be the court with territorial jurisdiction over the Studio’s registered office.
Personal data protection, collection, and processing are governed by a separate policy compliant with applicable personal data protection regulations.
An agreement for the performance of the Service by the Studio may not conflict with the principles set out in these Terms and Conditions.
Effective from: January 9, 2019
Voucher (gift card) – a document entitling the holder to use a specific service, service package, or monetary value at the Tattoo Studio. The Voucher may be purchased by the Client (Purchaser) for themselves or for a third party (Recipient).
Salon – AURA TATTOO, Tax ID (NIP): 9671285193
Recipient – the person redeeming the Voucher
Purchaser – the person purchasing the Voucher
The Voucher entitles the holder to use services in accordance with the Studio’s current price list.
The Recipient is required to book an appointment in advance, providing the Voucher number during booking by phone at +48 511 003 324, by e-mail at studio@auratattoo.pl, or in person at the Salon.
The Voucher must be presented before using the Service.
The Voucher must be redeemed within 12 months from the date of purchase. In exceptional cases, the Voucher’s validity may be extended. Each case will be considered individually by the Salon.
The Voucher is not redeemable for cash.
Vouchers purchased on-site at the Salon are non-refundable.
A Client who purchased a Voucher outside the Studio premises (e.g. by phone, e-mail, or social media – in electronic form or with postal delivery) has the right to withdraw from the agreement within 14 days from the purchase date. In such case, the Client is required to return the Voucher within the next 14 days to the Studio’s address. Upon receipt of the returned Voucher, the Studio will refund the purchase price along with return shipping costs within 14 days to the indicated bank account.
The Client intending to exercise the right of withdrawal must inform the Studio (by phone or e-mail) before the expiry of 14 days from the payment date. Failure to notify within this period results in loss of the right to a refund.
A Client purchasing a Voucher remotely with a redemption date falling earlier than 14 days after purchase acknowledges and accepts that in such case they lose the right to withdraw from the agreement.
The Recipient is obliged to pay the difference if the value of the selected Service exceeds the value of the Voucher.
Vouchers may not be combined with promotions, special offers, or discounts available at the Salon.
The Voucher may be redeemed during a single visit to the Salon.
The Voucher may be redeemed only at the Salon where it was purchased.
If the Client neither cancels nor reschedules the appointment before the scheduled date and fails to appear for the session, an amount of PLN 200 is deducted from the Voucher value.
In the event of a price list change after purchasing the Voucher:
The form of Voucher packaging and any additional items (e.g. freebies) depend on its value and the Studio’s decision.
All complaints related to Voucher redemption should be submitted in writing to the Salon address: ul. Marszałka Focha 10/5, Bydgoszcz, or by e-mail to: studio@auratattoo.pl.
Complaints will be considered within 30 days of receipt.
In matters not regulated by these Terms and Conditions, decisions are made by the Salon or governed by the Polish Civil Code.
